National Disciplinary Committee of Appeal (NDCA) chairman Cyril Ramaphosa left Malema with a glimmer of hope however, as he, along with his fellow appellants Floyd Shivambu, deputy president Ronald Lamola, treasurer general Pule Mabe, secretary general Sindiso Magaqa and deputy secretary general Kenetswe Mosenogi, will be allowed to make representations in mitigation of their sentences to the NDC.

"The appellants stated that the NDC committed a gross irregularity in dismissing the application for quashing of the charges," said National Disciplinary Committee of Appeal (NDCA) chairman Cyril Ramaphosa on Saturday.

"The NDCA sees no reason to bury the NDC's decision...consequently the appellants argument in this regard is dismissed."

Last year, the NDC found Malema guilty of provoking serious divisions in the league's parent body, the ANC, and bringing the organisation into disrepute.

Malema was suspended from the league for five years and told to vacate his position as president of the organisation.

Malema had made comments about sending a team to Botswana to consolidate local opposition parties and help bring about regime change.
